Misdemeanor, Does It Apply When Caught Speeding?

    So you or someone you know just got a speeding ticket and you want to know if it is a misdemeanor. The answer that that questions is bot no and yes! What do I mean by that? Well, chances are good that your speeding ticket was nothing more than a traffic violation. The only times speeding would be considered a misdemeanor is when you are speeding at an extremely reckless speed (well over 100 mph) and are putting other peoples lives in danger.

    A misdemeanor is defined in most legal systems as a non-indictable offence (or criminal act) that is regarded as less serious than a felony. In other words, misdemeanor is a minor wrongdoing that is punishable only by monetary fines. The fine must be paid within a specified period. If this time is not honored, the severity of the crime increases and may be indictable.

    In most jurisdictions, speeding is considered a traffic offense. By speeding, I mean driving over and above the recommended speed for a particular road. Generally, if you are driving at 20 to 30 miles above the speed limit indicated, then you have committed a traffic offense. The traffic officer who witnesses speeding issues a ticket containing the fine you are supposed to pay and when to pay it.

    Speed more often than not comes with a price. For instance, a speeding violation in United States is categorized as a Civil Infraction. Once you receive a spending ticket, you can plead guilty and pay it on the spot. The other alternative is to plead not guilty and together with the officer issuing it, attend a court hearing whereby the verdict can go either way.

    It is not always that a speeding ticket is a misdemeanor. Following a court hearing, you can be found not guilty and the ticket get thrown out. An officer can inaccurately issue a speeding ticket. Contesting such a ticket by pleading not guilty on the spot and opt for court hearing is recommended. Books regarding traffic offenses are good sources of information of some reasons of inaccuracy.

    Hiring an attorney to fight a ticket for you is a wise course to take. Armed with all information pertaining to the circumstances under which you were flagged down, such as the location of the traffic officer when he identified you as speeding, the weather, the road signs around you and such, there is a high probability that you will win the case.

    When you get a traffic violation such as speeding you have the right to challenge it and bring it to court. If you are going to challenge the ticket, it is extremely important to be respectful to the officer that pulled you over because you will be seeing them again in court and you have a better chance of getting out of the ticket if you showed the officer respect.

If you have been issued with a speeding ticket only, then you are safe to say that you have not been involved in a misdemeanor in case you are asked an interview. However, it will be good to confirm with your state legal system.
